Governing Law & Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of the Republic of South Africa.

The parties irrevocably agree that the courts of Cape Town, Western Cape, South Africa, shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter or formation (including non-contractual disputes or claims).

In the event of any dispute arising out of or in connection with these Terms and Conditions, the parties shall first attempt to resolve the dispute through good faith negotiations. If the dispute cannot be resolved through negotiations within thirty (30) days, either party may initiate formal legal proceedings in accordance with the jurisdiction clause above.

Notice shall be deemed given upon receipt if delivered personally, upon confirmation of receipt if sent by email, or three (3) business days after posting if sent by registered mail.

International guests acknowledge that by making a reservation with JamboHotels, they submit to the jurisdiction of South African courts and agree that South African law shall apply to any disputes. This does not affect any mandatory consumer protection rights that may apply under the laws of the guest's country of residence.
